Constitutionally Protected Events 

Events involving free speech, such as protests, demonstrations, or rallies, are protected under the First Amendment of the U.S. Constitution. Tacoma Venues & Events ensures that these events can occur while balancing public safety and community impact. Special provisions apply to reduce financial and logistical burdens on organizers of constitutionally protected activities.


Permit Requirements


Insurance and Financial Burden

  • The insurance requirement may be waived if the organizer demonstrates that obtaining coverage would create a financial burden.

    A verified statement must be submitted, including:

    • The purpose of the event.

    • A statement of attempts to obtain insurance and associated costs.

    • A statement from at least two independent licensed insurance brokers demonstrating the insurance is unavailable in the marketplace

  • A sliding scale or fee waiver is available for indigent applicants to ensure that financial barriers do not restrict constitutional rights.


Conditions for Road Closures

Events requiring temporary street closures must meet specific criteria, including:

  • No substantial interruption of public transportation or vehicular traffic.

  • No conflict with active construction or previously permitted events.

  • Compliance with emergency access requirements.

  • Coordination with city services to minimize disruptions.


Enforcement and Protections

City Support

The City will work with organizers to ensure that free speech activities occur in a safe and lawful manner.

Non-Interference with Constitutional Rights

If provisions of the municipal code conflict with the principles of free speech, the protections outlined in (TMC, Title 11.15.220) take precedence.

Exemptions from Specific Provisions

Sections of the special events code, such as those governing application fees and insurance, are not applicable to free speech events under certain conditions.

  • A Special Events permit is required for free speech activities if they involve:

    • Road or sidewalk closures.

    • The use of amplified sound.

    • Significant impact on public property or city services.

  • Applications for free speech events can be submitted up to seven days before the event date to ensure accessibility for time-sensitive activities.

    • For events not requiring road closures, fees are limited to administrative costs for processing the application.

    • For events requiring road closures, the City may recover costs for services, such as police staffing, up to a maximum of $500.
